1. Agreement
These Terms are an agreement between you and Eisaal Foundation (“we”, “us”), the publisher of the Eisaal app (the “App”). By downloading, opening or using the App, you accept these Terms. If you do not accept them, please do not use the App. Our Privacy Policy forms part of this agreement and explains how we handle your data.
2. Eligibility
To create an account you must be old enough to form a binding contract where you live, and at least 13 years old — or at least 16 if you are in the European Economic Area or the United Kingdom. The App is a general-audience religious utility and is not directed at children. Younger users may use the App’s offline features under the supervision of a parent or guardian.
3. Licence to use the App
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial religious practice. The App is licensed to you, not sold, and this licence transfers no ownership.
You may not: copy, sell, sub-license, rent or redistribute the App; reverse engineer, decompile or attempt to derive its source code (except to the extent this restriction is prohibited by law); remove or obscure any notices; extract or scrape the App’s bundled content databases for redistribution or for a competing product; or use the App in any way that breaks the law.
4. Your account
An account is optional, and the App’s core features work without one. If you create an account, you are responsible for the accuracy of what you enter and for keeping your sign-in method secure. Please tell us promptly if you believe someone else has accessed your account. You may delete your account at any time; the Delete Account page explains how.
If you enter information about another person — for example a parent’s or deceased relative’s name on a qaza profile — you confirm you are entitled to record it, and you remain responsible for it.
5. Acceptable use
- Do not use the App to harass, defame or harm anyone, or to promote hatred, violence or sectarian abuse.
- Do not attempt to gain unauthorised access to our systems, other users’ data, or our backend services.
- Do not interfere with, overload, probe or disrupt the App or the services it depends on, including automated scraping of our APIs.
- Do not upload anything unlawful, obscene, or infringing as a profile photo.
- Do not misrepresent the App’s content as a religious ruling issued by us or by any marja.
6. Religious content
The App is a devotional aid, not a source of religious rulings.
The Quran, duas, ziyarat, taqeebat, aamaal, translations and transliterations in the App are reproduced verbatim from published sources and are provided for personal devotional use. We do not author, paraphrase or machine-generate Arabic text, translations or transliterations.
Nothing in the App is a fatwa, an istifta’ answer, or religious, legal, financial, medical or professional advice. Where the App shows a position associated with a particular marja, it is a convenience reference and not an authoritative statement by that marja or their office. For any matter of obligation, always consult your own marja or their office, or a qualified scholar.
Despite careful sourcing, transcription and typographical errors remain possible. If you find an error in any Arabic text, translation, transliteration, attribution or ruling reference, please report it to shortfiqh@gmail.com. We check every report against the source and publish corrections in a subsequent update.
7. Prayer times, qibla and calendar
Prayer times are calculated on your device using the Ja'fari (Shia Ithna-Ashari) method, from your approximate location or the city you set, and are presented as three prayer windows: Fajr, Zohrain and Maghribain. The qibla direction is derived from your device’s compass and your location. Hijri dates depend on the calculation method used and on local moon-sighting decisions, which legitimately differ between communities.
All of these are calculated approximations. Sensor accuracy, magnetic interference, elevation, high-latitude conditions, an out-of-date location and differences between calculation conventions all affect the result. Where precision matters for the validity of an act of worship, verify against your local mosque, your marja’s office, or a physical compass.
8. Khums, qaza and other calculators
The khums calculator, qaza tracker, tasbeeh counter and Mohr-e-Ameen sajda tracker are personal record-keeping and estimation tools. They are not audited, not certified, and not a substitute for the judgement of your marja or their representative. Any figure the khums calculator produces is an estimate based on the values you enter and the rules you select. You remain responsible for calculating and discharging your religious obligations correctly.
9. Notifications
Reminders are scheduled locally on your device; there is no push server involved. Operating-system battery optimisation, Do Not Disturb and Focus modes, revoked permissions, device restarts and force-stopping the App can all delay or suppress them. Please do not rely on the App as your only means of knowing a prayer time.
10. Intellectual property
The App’s software, interface, design system, name and logo are owned by Eisaal Foundation and protected by intellectual-property laws. Religious texts and translations remain the property of their respective sources and rights holders and are included on the basis described in section 6; attributions appear alongside the content where available. The App includes open-source components, each governed by its own licence; a full list of those licences is available on request at shortfiqh@gmail.com.
11. Third-party services
The App relies on third-party services, including our backend and analytics providers, optional Google and Apple sign-in, bot protection at sign-in, and the OpenStreetMap Nominatim service used to look up city names. Each has its own terms and privacy policy, and we are not responsible for their acts or omissions. The Privacy Policy lists them all and states what each receives.
12. Price and availability
The App is provided free of charge and contains no advertising and no in-app purchases. We may add, change, suspend or remove features, or discontinue the App, at any time. If we introduce paid features in future, they will be clearly labelled and billed through the Apple App Store or Google Play under their own terms, and we will not change the price of anything you have already bought.
13. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that its content, prayer times, calendar dates or calculations will be accurate or suitable for your circumstances.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any consumer rights you have that cannot be waived by law.
14. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for loss of data, loss of profits, or loss of goodwill, arising from or relating to your use of the App — including any missed, late or incorrect prayer notification, any inaccurate prayer time, qibla direction, Hijri date or khums figure, or any reliance you place on the App’s religious content.
Our total aggregate liability arising out of or relating to the App is limited to the greater of the amount you paid us for the App in the twelve months before the claim, or ₹1,000 (one thousand Indian Rupees).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
15. Indemnity
You agree to indemnify us and hold us harmless against claims, damages and reasonable costs arising out of your misuse of the App, your breach of these Terms, or your infringement of anyone else’s rights, including through information you enter about another person.
16. Suspension and termination
You may stop using the App at any time by uninstalling it, and you may delete your account at any time from within the App or via the Delete Account page. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the App — and, where practical and lawful, we will give you notice and an opportunity to export your data first. Sections 6, 10, 13, 14, 15, 17 and 18 survive termination.
17. Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. The courts of Amroha, Uttar Pradesh, India have exclusive jurisdiction. If you are a consumer, you may also bring proceedings in the courts of your country of residence, and you keep the benefit of any mandatory consumer-protection rules that apply there. Before starting formal proceedings, please email us, so that we have the chance to resolve the matter directly.
18. Changes to these Terms
We may update these Terms. When we make a material change, we will update the effective date above and, where appropriate, notify you in the App. Continuing to use the App after a change means you accept the updated Terms. The current version is always published at https://eisaal.com/terms.html.
19. Additional terms for Apple App Store users
This agreement is between you and us only, not with Apple, and we — not Apple — are solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund your purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We are responsible for addressing any claim that the App or your use of it infringes intellectual-property rights, and for any product-liability, regulatory or consumer-protection claim relating to the App. You confirm you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
20. General
If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition or reorganisation. These Terms and the Privacy Policy are the entire agreement between us about the App.
